We stop what is keeping you up at night

The day we file your case, the automatic stay forces most creditors to stop. Here is what that means in plain terms.

🏠

Stop foreclosure

Have a foreclosure date on your Dallas or Fort Worth home? Filing halts the sale and gives you room to catch up or restructure what you owe.

💰

Stop wage garnishment

If a creditor is taking money from your paycheck, filing stops the garnishment so your full check comes home to your family.

🚗

Stop repossession

About to lose your vehicle? We move quickly to stop the repossession so you can keep getting to work and keep your life moving.

Filing bankruptcy in Dallas Fort Worth

Which court hears your case depends on the county you live in. Here is how it works across the metroplex.

Dallas Division

Earle Cabell Federal Building, 1100 Commerce Street, Dallas, TX 75242. Serves Dallas, Rockwall, Kaufman, Ellis, Hunt, Navarro, and Johnson counties.

Fort Worth Division

Eldon B. Mahon U.S. Courthouse, 501 W. 10th Street, Fort Worth, TX 76102. Serves Tarrant, Parker, Wise, Hood, Palo Pinto, Erath, Jack, and Comanche counties.

Both divisions are part of the U.S. Bankruptcy Court for the Northern District of Texas. One important detail many people miss: if you live in Collin County or Denton County, including Plano, Frisco, McKinney, and Denton, your case is filed in the Eastern District of Texas in Plano or Sherman, not the Dallas court. Knowing which court applies to your address is part of getting your case filed correctly the first time, and it is something we handle for you.

You also will not be filing alone or showing up to a courtroom in most cases. The one required hearing, the 341 meeting of creditors, is held by Zoom or phone in our districts. We prepare your paperwork, file the case, and walk you through that meeting in advance so there are no surprises.

In Texas, you keep more than you think

Texas has some of the most protective exemption laws in the country. For most families, bankruptcy is not about losing everything. It is about keeping what matters and clearing the debt.

Your homeTexas protects the equity in your primary home in most cases, subject to acreage limits and a federal cap if you bought it recently.
Your vehicleMost filers keep their car as long as payments stay current.
Your retirement401(k), IRA, and most pensions are generally protected.
Your wagesTexas strongly protects current wages from most creditors.

Exemptions depend on your specific situation. We review your numbers with you before you file so you know exactly what is protected.

What our clients say

Dallas Fort Worth bankruptcy FAQs

Straight answers to what DFW clients ask us most.

Which court will my Dallas or Fort Worth bankruptcy be filed in?
It depends on your county. Dallas County cases are filed in the Northern District of Texas, Dallas Division, at 1100 Commerce Street. Tarrant County and Fort Worth cases go to the Fort Worth Division at 501 W. 10th Street. If you live in Collin or Denton County, your case is filed in the Eastern District of Texas in Plano or Sherman.
Do I have to go to court in person?
In most cases, no. The one required meeting, the 341 meeting of creditors, is held by Zoom or phone in our districts. We prepare and file your case while you work from home, and we walk you through the meeting beforehand.
Can I keep my house if I file in Texas?
Usually yes. Texas has one of the most generous homestead exemptions in the country and protects your home equity in most cases, subject to acreage limits and a federal cap if you bought the home recently. As long as you stay current on the mortgage, most homeowners keep their house. We review your specific numbers before you file.
Will filing stop a wage garnishment or foreclosure?
Yes. The moment your case is filed, the automatic stay takes effect and most creditors must stop garnishment, foreclosure, repossession, and collection calls. If you are facing a foreclosure date or an active garnishment, this is exactly why we offer urgent same-day and weekend appointments.
How much does it cost?
We work on flat fees so you know your cost up front, with no surprises. The exact fee depends on your case type and situation, which we go over with you during your free consultation.
